Short, because this website does very little. It describes a company and gives you a way to reach it. Nothing is sold here and nothing is signed up for.

Who operates this site

blukernel.com is operated by BluKernel Labs, a registered sole proprietorship in India. It is not a company and not an LLP, so it has no CIN, and we will not imply otherwise. It is not registered for GST at present. In these terms "we", "us" and "our" mean BluKernel Labs and its proprietor; "you" means the person using the site.

Sheuli Mondal is our Grievance Officer and our nodal person of contact for compliance with the Consumer Protection (E-Commerce) Rules, 2020, at the address above.

These terms

By using this website you accept them. If you do not accept them, please do not use it. The Privacy Policy and the Refunds page form part of the same agreement.

These terms are written in English. If we publish a translation and the two differ, the English version binds — and if the difference matters to you, tell us, because it means we translated it badly.

What this site is

A description of BluKernel Labs: what the company does, how it works, and how to reach it. It is informational. Nothing on it is an offer, a quotation, a commitment to supply anything, or an invitation to invest.

What this site is not

• Nothing is sold here. There is no shop, no checkout, no subscription and no payment page, and we will never ask you for payment details on this site.
• There are no accounts. You cannot register, and there is no password of yours for us to lose.
• Nothing on it is professional advice of any kind — not legal, financial, medical or engineering advice on which you should act without your own assessment.
• We do not take client work or contract engineering. We build and operate our own products.

Using the site

Read it, quote it, link to it. Please do not try to break, overload, probe or reverse-engineer it, do not run automated tools against it, and do not scrape or copy it in bulk or use it to train an artificial intelligence model or any other machine learning system.

Please do not send us anything unlawful, anything that infringes someone else's rights, or anything containing code meant to damage a computer. Where an offence must be reported, we will report it to the appropriate authority.

Our products

BluKernel Labs operates its own software products, each governed by its own terms, privacy policy and refund policy rather than by this page. Where a product takes payment, it does so under its own terms, and its refund policy applies to it.

What belongs to whom

The BluKernel and BluKernel Labs names and marks, this website, its text, design, code and layout belong to BluKernel Labs. You may read and link to them. You may not republish, resell or redistribute them, or use them to train or develop a machine learning system.

If you send us a suggestion and we act on it, we owe you nothing for it, though we will usually say thank you. If you believe something here infringes your copyright or trademark, write to hello@blukernel.com with enough detail to identify it and we will deal with it within seven days.

Accuracy and availability

We try to keep this site correct and current. Some of it describes work in progress, and work in progress changes. Nothing here is a promise that a product will ship, ship on a date, or ship with a particular feature.

We do not promise the site will always be available. It is static and cheap to serve, so it usually is, but we give no uptime guarantee for a brochure page.

Links to other sites

Where we link elsewhere, we do not control that site and are not responsible for its content or its handling of your data. Its policies apply once you leave ours.

What we are liable for

We do not limit or exclude our liability at all for death or personal injury caused by our negligence, for fraud or deliberate wrongdoing on our part, for anything under the Consumer Protection Act, 2019 that cannot be limited by contract, or for anything else the law says may not be excluded. Nothing here restricts what a consumer commission, the Central Consumer Protection Authority, the Data Protection Board of India or any court may award.

Beyond that: this is an informational website that costs you nothing and takes nothing from you. We are liable for loss we caused that was a reasonably foreseeable consequence of our failure. We are not liable for indirect or consequential loss, or for a decision you took on the strength of a description of work in progress.

We have not written a clause excluding everything. A term leaving you with no remedy at all is an unfair contract term under sections 2(46) and 2(47) of the Consumer Protection Act, 2019, and an Indian court would not uphold it.

Governing law

These terms are governed by the law of India, and the courts at Bengaluru, Karnataka have jurisdiction. There is no arbitration clause, and that is a decision rather than an oversight. Nothing here stops you bringing a consumer complaint wherever the Consumer Protection Act, 2019 allows, including where you live or work.

Complaints

Write to hello@blukernel.com. Acknowledged within 24 hours, answered within three working days. If that has not resolved it, escalate to our Grievance Officer, Sheuli Mondal, at sheuli@blukernel.com — acknowledged within 24 hours, resolved within seven days, and within 15 days at the outside.

Beyond us: the National Consumer Helpline on 1915 or consumerhelpline.gov.in, a Consumer Commission under the Consumer Protection Act, 2019, a Grievance Appellate Committee at gac.gov.in for a content decision, or the Data Protection Board of India for personal data. The Contact page sets the ladder out in full.

Changes

The version and effective date at the top change when these terms do. For a material change we give 30 days' notice on this page. We keep every earlier version and will send you any of them on request.

Notices

A notice to us must be in writing, by email to hello@blukernel.com or by post to BluKernel Labs, 11th Floor, Innov8 Coworking Space, Prestige Tech Park, Platina 2, Outer Ring Road, Kadubeesanahalli, Bengaluru, Karnataka 560087, India. A notice about a grievance should be marked for the Grievance Officer. An emailed notice counts as received 24 hours after it is sent, and a posted one three days after posting.

The same address is where an order, notice or direction from a court, a government department or a competent authority should be sent. We acknowledge those in writing on receipt.
